Hillary Clinton may now be in more hot water over her email controversy.

The Justice Department just received a referral to open a criminal investigation into whether Clinton mishandled government information when she used her private email account as Secretary of the State, NBC reports.

Following the New York Times report, the emails under investigation were released from her server at the request of the State Department and the Office of the Director of National Intelligence. After the first memo assessment written to Patrick Kennedy, the under-secretary of state for management, 3,000 of the emails were made public on June 30. State Department officials examined them and also found that a portion of the emails were not deemed classified at the time they were handled by Clinton.

At a press conference in March, Clinton insisted she did not do anything out of protocol with the materials.

“I did not email any classified materials to anyone on my email. There is no classified material,” she said.

On July 17, a second memo was conducted and the inspectors general stated that at least one of the emails included classified information.

The Department of Justice has not confirmed if they will open an official investigation, but if Clinton is found responsible for the sharing of numerous confidential documents, she could be facing serious consequences. As it adheres to her position, it is unlawful for her to use any private email accounts or servers to handle classified government information.

Clinton’s campaign spokesman Nick Merrill stated, “As has been reported on multiple occasions, any released emails deemed classified by the administration have been done so after the fact, and not at the time they were transmitted.”

Although she maintains her innocence, Clinton continues to cooperate with the State and Justice Departments.
