Relatives of a man who died a year ago are suing the North College Hill police department, and the officer who used the taser gun on him.
The device took effect on Cory McGuinness, as police broke up a group fight.
The federal lawsuit, alleges that the taser international company earlier advised police not to shock subjects in the upper chest.
