The six Baltimore police officers involved in the death of Freddie Gray will go to trial, after a judge denied a motion to drop the charges in the case, USA Today reports.
In a hearing that lasted just over an hour and a half, Judge Barry Williams dismissed two key defense motions in the case: the various misconduct and murder charges the officers faced, and a motion for State Attorney’s Marilyn Mosby to recuse herself.
After the death of Gray, 25, in a police van in April, Mosby announced the officers would be indicted. The charges range from false imprisonment, to involuntary manslaughter and most seriously, depraved heart murder.
After Williams denied a motion to drop the case, he stated Mosby’s behavior at the now-infamous May 1 news conference was “troubling,” but did not affect the officers’ right to a trial. Williams also added in a statement to Andrew Graham, an attorney for Officer Caesar R. Goodson Jr., that Mosby’s marriage to a councilman doesn’t warrant a recusal.

Williams also said the assertion that Mosby’s judgment was impacted by the fact that her husband, Nick Mosby, is a councilman in a district that experienced a disproportionate amount of violence during the riots that Gray’s death sparked is condescending. “Being married to a councilman is not a reason for recusal.”
Here are the charges each officer will face, according to CNN:
- Officer Caesar R Goodson is charged with one count of second-degree depraved-heart murder, involuntary manslaughter, second-degree assault, manslaughter by vehicle (gross negligence), manslaughter by vehicle (criminal negligence), misconduct in office and reckless endangerment.
- Officer Garrett E. Miller is charged with one count of second-degree assault, two counts of misconduct in office and one count of reckless endangerment.
- Officer Edward M. Nero is charged with one count of second-degree assault, two counts of misconduct in office and one count of reckless endangerment.
- Officer William G. Porter is charged with one count of involuntary manslaughter, second-degree assault, misconduct in office and reckless endangerment.
- Lt. Brian W. Rice is charged with one count of involuntary manslaughter, one count of second-degree assault, two counts of misconduct in office and one count of reckless endangerment.
- Sgt. Alicia D. White is charged with one count of involuntary manslaughter, second-degree assault, misconduct in office and reckless endangerment.
As predicted, protesters came together outside of the courthouse in a cooperative manner. Police released multiple statements saying one person was arrested for “blocking a roadway,” and said reports that a Taser had been used were untrue. The Baltimore Sun identifies the person arrested as activist Kwame Rose.
The trial will begin in October.
