The family of a Detroit woman who was killed when the weapon of an off-duty police officer she was dancing with accidentally discharged are demanding that the case be reopened, reports Huffington Post.

Adaisha Miller was days away from her 25th birthday when she decided to dance with Detroit Police Officer Issac Parrish, 40, during a fish fry at his home.

His weapon, which was holstered, accidentally discharged, puncturing Miller’s lungs and heart. She was pronounced dead at the hospital.

Detroit Police Chief Ralph Godbee stopped just short of blaming Miller for the tragic, “unfathomable” accident.

“Somehow, in the course of dancing with the individual to his rear and touching his waist, his Detroit Police Department-issued weapon discharged, striking Ms. Miller,” Godbee said. “There is absolutely no indication that the officer placed his hand on his weapon at all.”

Yolanda McNair, Miller’s mother, refused to deflect from the issue at hand—why was he wearing his service weapon without the safety on while he was off-duty?

“For this to happen to her, whether they want to call it freak accident or mistake in judgment, it should have never happened to my child, and there’s nothing I can do to get her back,” McNair told WDIV-TV at the time.

“All she wanted to do was enjoy the weekend for her birthday,” McNair said. “She had every right to enjoy turning 25 and look beyond that.”

In a petition on Change.org, Miller’s family is asking Wayne County Prosecutor Kym Worthy to reopen the case.

The petition reads in part: 

Our [position] is that a thorough, unbiased investigation was not conducted and that there was a blatant disregard for due process, policy and procedures in regards to timely disclosure of evidence, information and results. 
Also we, the family of Adaisha Miller were purposely mislead about the reason the investigation was halted only to find out via the Sunday night news that your department had concluded it’s investigation without ever speaking to the family or friends of Adaisha– and the officer was CLEARED of any wrongdoing. 

We feel that you should Professionally revisit this case or ask an outside entity to conduct a proper one for you.

In an email to the Huffington Post, Wayne County Prosector’s Office spokeswoman Maria Miller said the case would not be reopened.

“The Wayne County Prosecutor’s Office conducted an extensive independent investigation of the facts and circumstances surrounding the death of Adaisha Miller and concluded that the evidence would not support charging the off-duty police officer,” Maria Miller said. “We do not plan to re-open the case.”
